End User License Agreement

This End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and the Provider of this Software (Brainwave - The Irish Epilepsy Association t/a Epilepsy Ireland) for the software product [Epilepsy Ireland App], which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("software product").
By installing the software product, you agree to be bound by the terms of this EULA.
If you do not agree to the terms of this EULA, do not install or use the software product.
Purpose of the software product
The purpose of the software product is to assist you in managing and taking control of your epilepsy:
- The seizure diary is a tool to help users record relevant information on their seizures.
- The reminder service assists users in taking their medications on time and keeping & preparing for medical appointments.
- The Consultation Guide is intended solely to help users prepare for discussions with healthcare professionals. Any information, prompts or suggested discussion topics referenced in the Consultation Guide are for informational purposes only and should not be relied upon as medical advice, diagnosis or treatment recommendations.
- The Emergency SMS feature enables users to send text messages using their own device and mobile network. Epilepsy Ireland does not monitor, receive or respond to such messages and cannot guarantee their delivery. The Emergency SMS feature is not an emergency response service and must not be relied upon as a substitute for contacting emergency services where urgent assistance is required.
The software product does not provide medical advice, diagnosis, treatment recommendations, monitoring, clinical decision support or emergency assistance. You should always seek the advice of an appropriately qualified healthcare professional regarding any medical condition or treatment.
Functionality
While every effort is made in ensuring that the software product fulfils its purpose in assisting users in managing their epilepsy, Epilepsy Ireland does not warrant that:
(i) the service will meet your own personal requirements,
(ii) the service will be uninterrupted or error-free,
(iii) the results that may be obtained will be accurate or reliable, or
(iv) any errors in the software product will be corrected.
To the extent permitted by law, in no event shall Epilepsy Ireland be liable for any direct or indirect or consequential/special loss or damage resulting from the use or the inability to use or any other matter relating to the functionality of the software product. Your use of the software product is at your own risk.
The software product provides reminders and notifications relating to medications, prescriptions, and medical appointments, as configured by the user. The delivery of reminders and notifications may depend on the correct functioning of the user's device, operating system and notification settings. Epilepsy Ireland does not guarantee that any reminder or notification will be delivered, received or acted upon. You remain responsible for managing your medications, prescriptions, appointments and healthcare requirements.
Epilepsy Ireland shall not be responsible for failures resulting from events beyond our reasonable control, including telecommunications failures, internet outages, cyberattacks, operating system changes, or third-party service interruptions.
Changes to the software product
Epilepsy Ireland reserves the right at any time, with or without notice, to update, modify or discontinue, temporarily or permanently, the software product or any part thereof. Epilepsy Ireland shall not be liable for any loss or damage arising from modifications, suspensions or discontinuance.
While we will attempt to notify users of upcoming updates and modifications via our website www.epilepsy.ie, such updates are at our discretion and may be pushed out to users automatically with little or no notice.
Should the software product be discontinued, it will continue to work on your device until device software updates render it obsolete. The software product may cease to function for a variety of other reasons, including, but not limited to damage to your device. In order to maintain uninterrupted service in the case of your device being damaged, lost or stolen, it is your responsibility to ensure that your data is backed up regularly using an appropriate, secure method.
Data Security
All the information you record using the software product will be held and stored locally on your own device and at your own risk. Epilepsy Ireland takes no responsibility for the security of data stored on your device. We recommend that you take all possible steps to keep your personal information secure.
You should note that if you choose to use device backup services or cloud storage services made available by third parties, copies of your data may also be stored or transmitted in accordance with the settings and terms applicable to those services.
Use of Information
Epilepsy Ireland's collection and processing of personal data is governed by our Privacy Policy. Please note that, in relation to the software product itself, Epilepsy Ireland does not maintain or have access to any of the personal information or health data that you store within the software product, including your username, PIN or answers to your security questions. All this information is stored on your own personal handset. Should you forget your PIN, you can retrieve your information by correctly answering the security question you selected when setting up your profile.
Data Ownership
All the information you record using the software product will be held and stored on your own personal device. Your profile and the data you upload belong to you. Epilepsy Ireland claims no intellectual property rights over the data you store or transmit.
Data Responsibility
The software product permits you to create and store information on your own device and to transmit this information from the software product by email services available on your device. Once information has been exported or transmitted from the softwareproduct, Epilepsy Ireland has no control over the security, storage, confidentiality, onward transmission or use of that information.
The safety, security and privacy of your device and the information that you store on it or transmit from it are your responsibility and not the responsibility of Epilepsy Ireland. The use of this data is therefore at your own risk. Epilepsy Ireland assumes no responsibility or liability for the delay, failure, interruption, or corruption of any data stored on or transmitted to or from.
You are responsible for maintaining the security of your username, PIN and security credentials. Epilepsy Ireland shall not be liable for any loss or damage arising from your failure to comply with this security obligation. Please note that Epilepsy Ireland cannot recover forgotten PINs or access credentials.
The software product enables users to record and store videos. Users are solely responsible for ensuring that they have any necessary permissions, authority and/or consent before recording, storing, sharing or otherwise processing information relating to another person. Epilepsy Ireland accepts no responsibility for the recording, storage, sharing or use of such information by users of the software product.
Copyright
The copyright for the software product and all the images and content contained belongs to Epilepsy Ireland and cannot be reproduced, duplicated, or sold by any other person or organisation without the express consent of Epilepsy Ireland.
Changes to Terms and Conditions
Epilepsy Ireland may update these Terms and Conditions from time to time. Updated versions will be made available through the software product and/or on our website, www.epilepsy.ie. Any new features added to the software product, including new tools and resources, will be subject to the updated Terms and Conditions. Continued use of the software product after notification of a material change constitutes acceptance of the revised Terms and Conditions.
Acceptance of Terms and Conditions
By activating the software product, you agree to the Terms & Conditions stated herein. You acknowledge that you are responsible for all use of the software product using your username, PIN and security credentials, and that these Terms and Conditions apply to all such use.
The software product is intended for use by adults over the age of 18 years, including parents, guardians and carers managing information relating to a child or another person in their care. Users who are minors are required to obtain the consent of their parents or guardians before consenting to these Terms and Conditions.
Third Party Platforms
The software product may be made available through third-party app stores, including the Apple App Store and Google Play Store. Apple Inc., Google LLC and their respective affiliates are not responsible for the operation, maintenance, support or content of the software product and are not parties to this Agreement. Any issues relating to the software product should be directed to Epilepsy Ireland and not to Apple or Google.
Governing law
This agreement will be governed by and construed in accordance with the laws of Ireland and any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Ireland.
